The law governing Commercial Energy Performance Certificates (EPCs) is set to change on 6 April.
Agents and others who market property must be aware that they may become liable for a Penalty Notice if marketing a property without a Non-Domestic EPC.
The Penalty Notice will be for a sum equal to 12.5% of the property rateable value subject a minimum fine of £500 upto £5,000 for both owner and any Agent
The current EPBD regulations will be amended on April 6th 2012. The commission of an EPC will now be a REQUIRMENT prior to marketing the sale or rental of non-domestic premises
A number of changes have been made to regulation 5A of the EPB (commecial EPC) Regulations.
In general, the onus remains on the ‘relevant person’ (i.e. the seller or landlord) to commission an EPC before marketing.
In a few weeks, Trading Standards Officers (TSOs) will have the power to require the seller or landlord to produce copies of the EPC. This power will be extended to include persons acting on behalf of the seller or landlord – e.g. estate, letting or commercial agents and their solicitors.
Fines of £5000 can be levied against all those failing to meet the new regulations
As publicised in Building magazine, it has been stated that under government plans all commercial buildings will require a Display Energy Certificate (DEC) which will be mandatory for all commercial buildings by October 2012. – This is part of green measures outlined this week in the coalition’s Carbon Plan.

The Financial Times reports that the slump in Oil prices since the 2008 recession appears to reversing, investor confidence appears to returning as oil companies start to fund new exploration for new supplies. However this is on the back of increasing demand from China, the market jumped at news that Oil futures are currently valued at $84 a barrel, a $10 jump in the last week. With the pound at a new low this week it certainly makes energy purchases more expensive if this trend remains; add the 2.5% increase in VAT in January business looks to be anticipating fuel price rises
The UK economy faces a "choppy recovery" over the next two years, the governor of the Bank of England, Mervyn King, has warned.
The Bank said the main factor behind its prediction that inflation would remain higher than previously forecast with anticipated fuel increases expected to reach 5% adding to the RPI. As well as the government's decision to raise VAT to 20% from 17.5% at the start of next year.

New research was released last week by the Carbon Trust stating that rising energy prices were one of the biggest worries facing British Businesses in 2010.
Forty nine percent of the 700 businesses surveyed were worried about the increases in energy costs. That was only 12% behind the biggest worry, which was the state of the economy at sixty one percent.
